RULES OF BOOKING AND ACCOMODATION
Valid from 15.01.2021
By making a reservation you accept these Rules.
The following terms are used in the content of the Rules:
Customer - a legal person or a natural person with legal capacity pursuant to the provisions of the Civil Code.
Service Provider - Grzechowiak Górskie Apartamenty Sp. k.with its registered seat in Zakopane at Oberconiówka 13e / 1.
Service - accommodation service provided by Grzechowiak Górskie Apartamenty Sp.z o.o Sp. k.for the Customer..
Agreement - mutual rights and obligations of the parties resulting from the agreement of accommodation in the premises.
Price for service - the amount indicated during the booking process, including all charges under the agreement.
Deposit - compulsory returnable deposit of 500 PLN per each apartment for any damage for each apartment / lost into apartment or public place inside of a Resort.

BOOKING AND PAYMENT TERMS
When making a reservation, the Customer selects the property offered by Grzechowiak Górskie Apartamenty Sp. k. via the website or portal mediating in concluding contracts, and then makes a reservation of a particular property by filling in the virtual booking form available on the website. The Customer can also make a reservation by phone at or by email.
The premises offered are intended for accommodation of a maximum number of persons indicated on the booking form. The Customer indicates the number of persons on the booking form. The number of persons may not exceed the maximum number designated for the premises.
Each additional person above the number specified by the Customer in the booking form for 14 days or less before planning check in will be charged an additional fee of 60 PLN per person/day. Between 22 December and 5 January, this fee is 120 PLN per person/day.
The reservation is confirmed through an email delivered to an e-mail address provided by the Customer during the booking process .
The Customer is obliged to pay the full amount if less than 14 days remain until his/her arrival. If there are more than 14 days left until the start of the stay, 30% of the booking price must be paid. 14 days before arrival each stay must be paid 100% in case of flexible price list , flexible price list with breakfast or Longer= Cheaper.
The Customer is obliged to pay the full amount on the day of booking.The non-refundable offer guarantees the lowest price , but cancellations or modifications cannot be made.
The Customer is obliged to make an advance payment or to pay the whole amount within 1 hours from receiving the booking confirmation through one of the payment methods specified in the e-mail message.
Failure to make a payment within 1 hours of booking results in immediate cancellation of the reservation.
The receipt is the proof of purchase. If the customer needs an invoice for their stay, they are obliged to provide this information before making payment. Once the receipt has been issued, it is not possible to issue an invoice.
The Service Provider may refuse to accept a Customer who grossly violated the rules during the previous stay, causing damage to the property of the facility or the property of the guests, or damage to the Guest or employees or other persons staying on the premises, or otherwise disturbed the peaceful stay of other customers or the functioning of the facility.
II
CANCELLATION AND CHANGES OF BOOKING
Free cancellation and any changes to the booking can be made up to 14 days before the start of the stay. Each change is agreed individually and is subject to availability. The Service Provider reserves the right to refuse to make changes or to charge additional fees. All monies paid shall be refunded within 14 working days. In the case of a return to a foreign account, a fee of 50 PLN is collected.
If the Customer cancels the reservation after the agreed date, he/she is not entitled to the refund.
The Customer's early departure from the premises does not entitle him/her to a refund for the unused part of the stay.
Grzechowiak Górskie Apartamenty Sp.z o.o Sp. k.has the right to cancel the reservation without giving any reason within 48 hours from the moment of making the reservation. In the case of cancellation of a reservation by Grzechowiak Górskie Apartamenty Sp.z o.o Sp. k., the paid advance payment or the fee for the stay will be refunded within 14 working days.
III
TERMS OF STAY
The stay starts no earlier than 4:00 pm and ends on the last day no later than 11:00 am.
The reception desk is open from 9:00 am to 8:00 pm.
If the Customer does not leave the premises by 11:00 am, the Service Provider has the right to charge the Customer with the amount of PLN 250 for late check-out.
After agreeing with the reception, subject to availability, it is possible to extend the stay on the day of departure until 5:00 pm. The cost is PLN 250.
Arrivals after 9:00 pm are charged additionally PLN 100 upon prior arrangement of the resident's availability.
In the event of failure to show up by 11:59 pm on the day of arrival - the reservation will be cancelled, the Customer will not be entitled to a refund, and the apartment will be offered for resale.
When collecting the keys to the apartment, the Customer shows an identity card and pays a returnable deposit. The deposit is charged in the form of a payment card pre-authorization (card number and expiry date must be provided). The deposit is unlocked within 3 days from the day of check-out. In case of refusal to pay the deposit the keys will not be handed over. The period of blocking funds on the account is usually from 7 to 14 business days, depending on the bank.
In order to perform the agreement, the client will receive a code for the entrance gate to the facility and a code for the door to the staircase, as well as the keys to the apartment on the day of arrival. The customer is obliged not to disclose codes and keys to third parties, except for people who stay with them in the apartment during the stay.
In the event that the Customer grossly violates the peace and / or welfare of the neighbours and does not comply with the commonly used standards of coexistence between household members and guests - the Service Provider reserves the right to terminate the Customer's apartment stay agreement with immediate effect. In such a situation, the Customer will not be entitled to a refund for the unused period of stay.
The Service Provider reserves the right to refuse the stay of tourists who came with more people than specified in the booking terms and conditions. Any change in the number of people should be reported at least 48 hours before the planned arrival in order to prepare the apartment.
After the end of the stay, the Customer is obliged to hand over the apartment and return the keys to the Service Provider or an authorized person.
The Customer is forbidden to transfer the apartment to third parties.
At check-in, a local tax is collected in the amount of PLN 2 per person/day, payable in cash.
The condition for the return of the deposit is to leave the premises in a proper order, in a non-deteriorated condition and to leave all the equipment of the premises (including household appliances and audio/video devices) in a condition suitable for further use.
The Customer bears full financial responsibility for any damage / lost or destruction of equipment and technical devices in the apartment caused by their fault or the fault of their visitors.In ase of any damage / lost total price will be covered by deposit.All damage / lost will be sent to Customer via mail, phone and tourist portal.
Children under 3 years of age (one per apartment) sleeping with adults or in their own cot and not requiring bed linen do not pay any fees for the stay. Other children pay the regular price and are treated as adults.
The Service Provider is obliged to respond to every contact attempt made by the Customer.
The Customer is obliged to report any defects in the premises immediately upon their discovery next 2 hours time from check - in .
The Service Provider has the right to refuse to stay under the influence of alcohol or drugs. The Customer is not entitled to a refund for an unused booking.
The Customer may only use the fireplace only when he/she is present in the apartment (this applies to electric fireplaces). It is strictly forbidden to light a fire in traditional fireplaces.
Third parties who are not registered in the apartment may stay there only with the consent of the landlord.
In the event of a threat to his/her life or health (as well as other persons staying in the flat with them), the Tenant (guest) is obliged to call the building security immediately - using the contact details provided on the day of arrival.
The Service Provider states that not all elements of the decoration visible in the photos used for the photo session are available in the offer.
Rules of use of the SPA area are set out in separate regulations to be found in the SPA area.
Each apartment comes with one free of charge parking space. Additional parking space (if available) costs PLN 60 per day.
The facility offers massages that can be purchased during your stay according to the current price list. Free cancellation is possible until 8 p.m. the day before the planned massage, otherwise the guest will be charged the full cost of the service.
The following rules apply in the premises (500 PLN in case broken rules or in case unfounded fire brigade attend to cover all expenses ):
Quiet hours from 10:00 pm – 6:00 am.
No smoking .
No pets allowed
No parties such as stag and hen parties or special events
No use of intoxicants
No use of candles , incense etc.
No move the equipment of the apartment to other apartment (table, chair, glass etc.)
No take furniture out on the balcony/terrace.
IV
RESPONSIBILITY
Grzechowiak Górskie Apartamenty Sp.z o.o Sp. k. does not bear any responsibility for items belonging to the Customer left in the premises after the check-out date.
In the event of loss of a set of keys, the Customer will be charged the following costs:
Keys PLN 100.
Chip PLN 40
Gate remote control PLN 200
Magnetic card for lock PLN 100
The Customer will be charged PLN 100 for damage or loss of the pool band available in the premises (the number of pool wristbands corresponds to the maximum number of beds in the flat).
A lost bathrobe will cost PLN 100.
We inform you that the ROYAL RESORT SPA ZAKOPANE facility is monitored.
All matters not provided for in these Rules shall be governed by the provisions of the Polish Civil Code.
V
ANIMALS
Grzechowiak Górskie Apartamenty Sp.z o.o Sp. k. does not allow animals to stay in the apartment.
A customer who would like to stay in the premises with an animal is obliged to ask for individual consent to stay with animals before making a reservation.
If the Service Provider agrees to the stay of animals, the Customer is obliged to pay a fee of PLN 80/day.
Animals can not stay alone in the apartment.
VI
COMPLAINT
If it is found that the provision of services is incompatible with the Agreement, any complaints may be submitted by the Customer in electronic form to the address info@grzechowiakzakopane.pl within a period not exceeding 14 days from the date of completion of the stay.
The complaint shall be considered within 14 days of its receipt. The client will be informed of the decision by e-mail.

Information clause
Pursuant to Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation- GDPR) – the “Regulation”, I inform that:

3. Your personal data, i.e. name and surname, address, e-mail, telephone number, address will be processed for marketing purposes or for the performance of a rental agreement to which the data subject is a party pursuant to Article 6(1)(b) or pursuant to Article 6(1)(a) if the processing is based on the consent granted.
4. In connection with the processing of data for the purposes indicated in point 2, your personal data may be made available to other recipients or categories of recipients of personal data, i.e. the Tax Office, the Social Insurance Institution, companies operating the electronic payment system, IT companies, accounting office, with which we have concluded an agreement on entrusting the processing of personal data, etc.
5. Your personal data will be stored from the moment of its collection for a period of time, e.g. until revocation of consent, if any, and, after such revocation, for the period of the statute of limitations for claims to which the controller is entitled and in relation to the controller.
6. You have the right to request the controller to access your personal data, as well as the right to rectify, erase or restrict their processing, and to object to their processing.
7. If the processing is based on Article 6(1)(a), i.e. on the basis of consent, you have the right to withdraw your consent at any time without affecting the legality of the processing performed on the basis of consent before its withdrawal.
8. You have the right to lodge a complaint with the President of the Personal Data Protection Office, if you feel that the processing of your personal data violates the provisions of the Regulation.
9. Providing your personal data is a condition for entering into an agreement. Failure to provide personal data may result in the refusal to perform the purposes of the agreement indicated above.
10. Personal data processed by the Controller on the basis of the Regulation shall not be subject to automated decision-making, including profiling, referred to in Article 22(1) and (4) of the Regulation.
